Terms of Service

You must meet all of the following conditions to use the Service:

• You satisfy the minimum age requirement set by Discord's own Terms of Service (currently 13 years of age, or the applicable minimum age in your jurisdiction if higher).
• You are not prohibited from receiving or using the Service under the laws of your country, state, or any other applicable jurisdiction.
• Your Discord account is in good standing and has not been suspended or terminated by Discord.

If you are using Orion on behalf of a Discord server, organization, team, or community, you represent and warrant that you have the authority to bind that entity to these Terms, and that entity agrees to be responsible for your use of the Service.

You are solely responsible for all activity that occurs through your Discord account in connection with Orion, whether or not you authorized that activity. You must maintain the security of your Discord credentials and promptly notify us if you believe unauthorized use has occurred. MallyDev is not liable for any loss or damage resulting from unauthorized access to or use of your account.

Server administrators who invite Orion are responsible for ensuring that the Bot's use within their server complies with these Terms, Discord's Terms of Service, and any applicable laws. This includes configuring appropriate channel permissions and informing server members that an AI bot is active.

You may use Orion for its intended purposes, including but not limited to:

• Asking questions, requesting summaries, and receiving conversational AI responses.
• Using coding assistance, debugging help, and technical guidance features.
• Leveraging memory and context features for continued conversations.
• Using server context features where Orion reads publicly available channel content you direct it to process.
• Any other feature or capability the Service makes available through its standard interface.

All use must be lawful, in good faith, and consistent with the spirit of these Terms.

You agree not to use the Service to:

• Engage in, promote, or facilitate any illegal activity, including but not limited to fraud, money laundering, trafficking, or distribution of illegal content.
• Harass, threaten, defame, stalk, intimidate, or abuse any individual or group.
• Generate, distribute, or store content that is sexually explicit involving minors, non-consensual intimate imagery, or any content that exploits or endangers children.
• Send spam, chain messages, unsolicited advertising, or automated bulk requests.
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code, algorithms, or underlying models of the Service.
• Attempt to bypass, circumvent, or disable any rate limits, safety filters, content moderation, access controls, or other protective measures.
• Use the Service to develop competing products or services, or to benchmark the Service for competitive purposes without written consent.
• Impersonate MallyDev, Orion, any other bot, or any person or entity, or misrepresent your affiliation.
• Upload or transmit viruses, malware, or any code designed to disrupt, damage, or limit the functionality of the Service or any connected system.
• Use the Service to generate content that could reasonably be used to cause real-world harm, including instructions for weapons, dangerous substances, or self-harm.
• Exploit the Service to extract training data, model weights, or system prompts.
• Use automated scripts, bots, or other programmatic means to interact with Orion without prior written authorization.

This list is not exhaustive. MallyDev reserves the right to determine, in its sole discretion, whether any use violates the spirit or letter of these Terms.

You retain ownership of any content you submit to Orion, including prompts, messages, files, images, and attachments ("User Content"). By submitting User Content to the Service, you grant MallyDev a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, store, and transmit that content solely as necessary to:

• Operate the Service and deliver responses to your requests.
• Maintain, debug, and improve the reliability and performance of the Service.
• Enforce these Terms and our policies, including abuse prevention.
• Comply with applicable legal obligations.

This license exists only for the duration and to the extent necessary for these purposes. We do not claim ownership of your content, and we do not use User Content to train AI models unless explicitly stated otherwise in a separate notice.

You represent and warrant that you own or have all necessary rights, licenses, and permissions to submit any User Content, and that your content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party.

The Service, including its design, code, branding, documentation, website, and all associated intellectual property, is and remains the exclusive property of MallyDev or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

The Orion name, Orion AI logo, and all related marks are trademarks of MallyDev. You may not use these marks without prior written permission, except as reasonably necessary to identify the Service in the context of normal use (for example, stating that your server uses the Orion bot).

Orion generates responses using artificial intelligence. You acknowledge and agree that:

• No guarantee of accuracy. AI-generated output may be incomplete, incorrect, outdated, misleading, or entirely fabricated ("hallucinated"). The Service does not guarantee the truthfulness, reliability, or fitness of any output for any particular purpose.
• Not professional advice. Orion output does not constitute legal, financial, medical, psychological, or any other form of professional advice. You should always consult a qualified professional before making decisions based on AI-generated content.
• Your responsibility. You are solely responsible for evaluating, verifying, and deciding whether to rely on any output. This is especially critical when outputs involve moderation actions, technical troubleshooting, safety-critical decisions, current events, or actions that could affect other people.
• No liability for output. MallyDev accepts no liability for any consequences arising from your use of or reliance on AI-generated output, including but not limited to decisions made, actions taken, or content published based on that output.

Orion operates on Discord and may rely on third-party infrastructure, APIs, AI model providers, hosting services, and other external systems. Your use of the Service is also subject to Discord's Terms of Service, Community Guidelines, and Privacy Policy. MallyDev is not responsible for the actions, policies, outages, or data practices of any third-party service.

If Orion references, links to, or retrieves content from external sources, this does not imply endorsement, affiliation, or responsibility for that content. You access third-party content at your own risk.

The Service is provided on an "as available" basis. MallyDev does not guarantee uninterrupted, error-free, or continuous access to any part of the Service. Without prior notice, we may:

• Perform scheduled or emergency maintenance that temporarily reduces or suspends availability.
• Modify, add, or remove features, commands, capabilities, or integrations.
• Impose or adjust rate limits, usage quotas, file size restrictions, or other operational constraints.
• Temporarily or permanently discontinue any part of the Service.

We will make reasonable efforts to communicate significant changes in advance when practical, but are not obligated to do so. You acknowledge that the Service may experience downtime and that MallyDev shall not be liable for any loss, inconvenience, or damage resulting from service interruptions or modifications.

MallyDev reserves the right, at its sole discretion and without prior notice or liability, to suspend, restrict, or permanently terminate your access to the Service for any reason, including but not limited to:

• Violation or suspected violation of these Terms or any applicable law.
• Abusive, fraudulent, or harmful behavior directed at the Service, its infrastructure, or its users.
• Attempts to circumvent security measures, rate limits, or content filters.
• Requests from law enforcement or government agencies.
• Unexpected technical or security issues that require immediate action.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including but not limited to Sections 5, 6, 7, 11, 12, 13, 14, 16, and 17) shall remain in full force and effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MALLYDEV EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

MallyDev does not warrant that the Service will meet your requirements, that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from using the Service will be accurate or reliable, or that any defects in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MALLYDEV, ITS AFFILIATES, CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, goodwill, reputation, or other intangible losses, arising out of or in connection with:

• Your access to, use of, or inability to use the Service.
• Any content, output, or information obtained from or through the Service.
• Unauthorized access to or alteration of your data or transmissions.
• Statements, conduct, or actions of any third party on or through the Service.
• Any other matter relating to the Service.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, MallyDev's total cumulative liability shall not exceed the greater of fifty US dollars (USD $50.00) or the total amount you have paid to MallyDev for use of the Service in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless MallyDev, its affiliates, contributors, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your User Content, including any claim that your content infringes or violates the rights of a third party.
• Any dispute between you and another user or third party related to the Service.

If a dispute arises between you and MallyDev relating to the Service or these Terms, both parties agree to first attempt to resolve the matter informally by contacting us at malawarettv@gmail.com. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction.

To the extent permitted by applicable law, you agree that any claim or cause of action arising from or relating to these Terms or the Service must be filed within one (1) year after the claim arose. Failure to file within this period constitutes a permanent waiver of that claim.

MallyDev reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document. We may also make reasonable efforts to notify users through the Orion community server or other channels, but are not obligated to provide individual notice.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service immediately.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MallyDev regarding the Service and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, relating to the Service. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision.
